Real-World Applications
Common Mistakes to Avoid
Calling employees 'managers' or 'independent contractors' to avoid overtime is an FLSA violation. Job title alone doesn't determine overtime eligibility - actual job duties and salary threshold matter.
California, Colorado, Kentucky, and other states have daily overtime requirements (OT after 8 hours/day) in addition to the federal weekly threshold. State rules apply if more favorable to the employee.
Under FLSA, overtime is calculated per workweek (7 consecutive days), not per pay period. Working 50 hours one week and 30 the next = 10 hours OT, not 0 OT despite an 80-hour biweekly total.
