Common Mistakes to Avoid
Attorney fees in statutory percentage states (CA, FL) are often calculated on GROSS estate value before debts. A $500K house with a $400K mortgage still generates attorney fees based on $500K in California.
Life insurance with named beneficiaries, retirement accounts, POD/TOD bank accounts, and joint tenancy property all pass outside probate. Only assets in the decedent's name alone typically go through probate.
